Draft for counsel. Not legal advice.
Terms of Service
EberApp, LLC, a Utah limited liability company (“DisputeClerk”, “we”). Last draft: October 26, 2026. Contact legal@disputeclerk.com.
The service
DisputeClerk is a software service that helps a Stripe merchant gather records and submit dispute evidence. Installing the Stripe app authorizes DisputeClerk to read the permitted dispute, charge, customer, invoice, subscription, checkout, product, file, and event data, and to upload files and update disputes on that account, including staging and submitting evidence.
No promised outcome
Card networks decide disputes. We do not guarantee a win, a reversal, or any recovered amount. Playbooks and narratives are aids. You remain the merchant of record.
Your warranty
You warrant that the policy pages, product description, support address, usage events, and any narrative text you edit and acknowledge are accurate and that you have the right to share them. If you acknowledge an edited sentence that our fact check could not ground, you warrant that sentence yourself.
Subscription
The plan is $49 per month after a 14-day trial, billed by Stripe Checkout on EberApp’s account. You can cancel from the dashboard. Cancellation stops future renewals. Fees already paid are not refunded except where required by law. The pipeline runs while the subscription is trialing or active.
First cases and submission
The first three disputes we recommend fighting require your approval before submission. After that, if auto-submit is on, we submit the staged packet about 48 hours before the evidence deadline. You can turn auto-submit off. You cannot turn off the first-three approval rule.
Liability
To the extent the law allows, EberApp’s total liability arising out of the service in a claim is capped at the fees you paid to EberApp for DisputeClerk in the three months before the claim. We are not liable for lost profits, lost disputes, network fees, or Smart Disputes fees charged because a submission was not actually manual. Some jurisdictions do not allow these limits.
Law
These terms are governed by Utah law. State and federal courts located in Utah are the venue for disputes about the service, except where the law requires otherwise.
This page is a draft for review by counsel. It is not a substitute for legal advice and is not the final customer agreement until counsel approves it.
